Dave takes a call from Ed of Pensacola, Florida. Ed is worried about the recent Eviction Moratorium brought forward by the Center for Disease Control (CDC). Ed has been listening to the local media coverage, but he is unsure what this is gonna mean for his rental property. Ed’s local anchor has been hinting at the government taking control of rental properties. Dave reassures him that no, they won’t take his property; there are too many guns in America, he jokes. Dave tells Ed that the CDC does not have the power to enforce the Moratorium; it’s more a suggestion. Furthermore, there are currently no federal laws that state this. The only option they have is to enforce them on federally funded lands. Dave sites Tennesse having a local moratorium during the height of covid that held up even Daves property.
David does not know state by state what each law is but would be shocked to hear if Governor Ron Desantis would have anything like that. He suggests finding a local attorney that handles evictions and getting their input. Dave states that it is not the federal law that covers property but the state where the property resides. However, Dave doubles down that the CDC does not have the power to enforce that they are merely a suggestion. Dave tells Ed that he needs to be worried more about local and county legislature than the CDC or Federal to enact a moratorium. Finally, his last words to comfort Ed are that private property is not under federal jurisdiction but the state.
